Germany’s federal court put particular emphasis on the fact that market research indicated that 70% of respondents associated the gold tone with the Lindt GOLD BUNNY. Lindt & Spruengli previously unsuccessfully attempted to obtain trademark protection for the shape of such Lindt GOLD BUNNY.
